Competition Terms & Conditions

  1. The promoter is Expedia Australia Pty Ltd ACN 101 694 946 of Level 5, 95 Pitt Street Sydney NSW 2000 ("Promoter").
  2. Information on how to enter and prizes form part of these terms and conditions of entry. Participation in this Promotion is deemed acceptance of these terms and conditions.
  3. Subject to section 4 below, entry to the Promotion is open to Australian residents who:
    • are aged 18 years or over;
    • are able to attend the 2008 Toyota AFL Grand Final in Melbourne, Victoria; and
    • participate in the Promotion in accordance with all relevant terms and conditions.
  4. The Promoter, its employees (and their immediate families), participating agents and their associated agencies and suppliers are not eligible to enter or win the Promotion.
  5. The Promotion commences at 00:00.01 AEST on Monday, 21 July 2008 and concludes at 11:59:59 AEST on Sunday, 31 August 2008 ("Promotion Period"). Entries received before or after the Promotion Period will be ineligible to win.
  6. Entry into the Promotion requires an eligible entrant to undertake the following steps during the Promotion Period:
    • an eligible entrant ("Entrant") must visit http://comp.expedia.com.au and:
      • correctly answer the 3 multiple-choice questions about Expedia.com.au;
      • provide all contact information requested on that webpage; and
      • choose to receive email newsletters from Expedia.com.au.
    ("Initial Entry");
    • upon successful completion of the Initial Entry, the Entrant will be given the opportunity to refer friends ("Friend") to the Promotion. An Entrant may refer Friends to the Promotion by sending the Friend(s) an email with a unique referral code provided by Expedia.com.au. There is no limit to the number of Friends that an Entrant may refer; and
    • the Friend will then receive an email from the Entrant containing a link to http://comp.expedia.com.au which allows the Friend to participate in the Promotion as per this section.
  7. Upon completion of the steps (a) and (b) above, the Entrant and/or the Friend(s) (as the case may be) (together the "Eligible Participants") will be entered into the Promotion. If the Friend has already entered into the Promotion, the Friend will not be able to enter again.
  8. Only complete and correct entries are eligible for entry. Incomplete or indecipherable entries will be deemed invalid. If a winning entry is deemed invalid, the entry will be discarded and a new winner will be drawn for the relevant prize from the reamaining eligible entries.
  9. There is a limit of one entry per person or email address.
  10. Entries will be deemed accepted at the time of receipt and not at the time of transmission. No responsibility will be taken for lost, late or misdirected entries.
  11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who the Promoter has reason to believe has breached any of these Terms and Conditions or who has engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s rights to recover damages or other compensation from such an individual are reserved. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  12. There will be two (2) prize winners for the Promotion. There will be one initial prize winner ("Initial Prize Winner), who will win the prize described in section 12 below ("Prize"). As set out in sections 18 and 19 below, there will also be one (1) supplementary prize winner for the Promotion, who will also win the Prize ("Supplementary Prize Winner").
  13. The Prize consists of the following:
    • subject to section 13 below, return economy class airfares to Melbourne, Victoria departing from the closest of the following locations Sydney, Brisbane, Adelaide, Perth, Hobart or Darwin ("Airfare Component");
    • 2 nights twin-share accommodation for 2 people in a 4 star hotel in Melbourne;
    • 2-day car hire;
    • subject to clause 23 below, 2 tickets to the 2008 Toyota AFL Grand Final and 2 tickets to the Sydney Swans Grand Final Breakfast ("AFL Tickets"), both held on Saturday 27 September 2008; and
    • $1,000 cheque payable to cash.
  14. All elements of the Prize must be taken together. If the prize winner(s) is a resident of Victoria, Australia, the Airfare component of the prize will not be awarded, and cash will not be awarded in lieu of that element of the prize.
  15. Total prize pool is valued at AU$9,600. The prize value is in Australian dollars and includes GST. The prize value is correct at the time of printing and the Promoter accepts no responsibility for any subsequent variation in value of the prizes.
  16. All prizes are subject to availability. The prizes cannot be altered in any way and are not transferable to another individual, exchangeable or redeemable for cash. The winner cannot change, vary, substitute or extend any element of the prize (in whole or in part).
  17. If the Prize (or any part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority or a State regulation.
  18. In relation to the Promotion, at 12:00pm AEST on Monday, 2 September 2008 at the offices of Expedia Australia Pty Limited, Level 5, 95 Pitt Street, NSW 2000, an Initial Prize Winner will be randomly selected from the pool of eligible entries received.
  19. If the Initial Prize Winner selected in section 17 above is deemed to be a Friend pursuant to section 6(b) above, a Supplementary Prize Winner will be selected with the Supplementary Prize Winner being the relevant Entrant who referred the Friend selected as the Initial Prize Winner based on the unique referral code.
  20. If the Initial Prize Winner selected in accordance with section 17 above is not deemed to be a Friend pursuant to section 6(b) above, the Supplementary Prize Winner shall be determined by randomly selecting a further entrant from the pool of eligible entries received.
  21. The winner(s) will be notified by email within seven (7) business days and their name(s) published in The Australian on 10 September 2008 and on the Expedia.com.au website.
  22. The Promoter’s decision is final on all matters relating to this Promotion and no correspondence will be entered into.
  23. To claim the prize, the prize winner(s) may be required to provide proof of identity, proof of age and proof of Australian residency. Identification considered suitable for verification is at the discretion of the Promoter. In the event that for any reason whatsoever a prize winner does not claim the prize, or any part of it, at the time stipulated by the Promoter, then the prize will be forfeited and cash will not be awarded in lieu of the prize.
  24. An unclaimed prize draw will take place at the offices of Expedia Australia Pty Limited, Level 5, 95 Pitt Street, Sydney NSW 2000 on 2 December 2008 at 12:00pm (AEST) and winner(s) will be published in The Australian on 10 December 2008. In relation to the AFL Tickets element of the Prize, a prize of equivalent value will be substituted for the AFL Tickets at the discretion of the Promoter.
  25. Unless expressly stated in these terms and conditions all other expenses (including, without limitation, travel to and from the departure point, spending money, meals, drinks, activities (unless specified), incidentals, taxes (including departure taxes), services charges, travel insurance and all other ancillary costs) become the responsibility of the winner.
  26. The winner(s) and travelling companions must travel at the same time, must depart from the same departure city as described in section 12 above and are responsible for transport from their residence to their nearest departure city’s airport for flight departure.
  27. Frequent flyer points are not available and cannot be claimed in connection with the Prize. It is a condition of accepting that the winner must comply with all the terms and conditions of use the relevant prize and the prize supplier’s requirements.
  28. The winner must comply with all terms and conditions imposed by the car rental company appointed by the Promoter ("Car Hire Company") at the time of the car hire.
  29. The driver of the car must have a current Australian State or Territory license (which is not under suspension or cancellation) as at the date on which the winner (or companion) is to drive the vehicle.
  30. Winner may be required to present credit card or provide a cash deposit at the time of accommodation check in for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
  31. Each entrant warrants that, during the entry process: each person that they nominate to register as a Friend for the purposes of gaining entry into the promotion is an Australian resident aged 18 years and over and is a person who would consent to receiving a promotional email from the entrant.
  32. It is the traveller’s personal responsibility to ensure that they have valid documentation including, without limitation, identification and other travel documents which meet the requirements of government authorities at the destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller.
  33. To the extent permitted by law, if for any reason this Promotion is not capable being run as planned, due to causes beyond the Promoter’s control including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, or technical failures which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available and/or to cancel, terminate, modify or suspend the Promotion.
  34. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, acts of terrorism, natural disasters, civil unrest, strikes or any other event beyond the control of the Promoter; the Promoter may in its discretion cancel, terminate, modify or suspend the Promotion.
  35. The Promoter and its associated agencies, will take no responsibility for prizes damaged or lost in transit, or any late, lost or misdirected emails or entry.To the extent permitted by law, the Promoter and its associated agencies and companies associated with this Promotion will not be liable for any misadventure, accident, injury, loss (including but not limited to indirect or consequential loss and loss arising from negligence), damage or claim that may occur, or for personal injury suffered or sustained:
    • while participating in the Promotion;
    • whilst undertaking any travel connected with their entry into the Promotion or any prizes won as a result of accepting any prize,
    • in relation to failure of any entry to be received by the Promoter as a result of technical difficulties or traffic congestion;
    • arising from or related to any problem, technical difficulties or equipment malfunction of any computer equipment, software, internet connection, any injury or damage to an entrant’s or any other persons computer or software related to or resulting from participation in this Promotion;
    • any variation in prize value to that stated in these Terms and Conditions;
    • if the 2008 Toyota AFL Grand Final is cancelled for any reason beyond the reasonable control of the Promoter;
    • due to any act or omission (whether negligent or not) of the Promoter, its associated agencies or any agents or contractors; and
    • due to circumstances outside the Promoter’s and its associated agencies reasonable control.
  36. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner (and any travel companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
  37. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter.
  38. By entering the Competition and signing up to the Expedia.com.au newsletter, each entrant consents to the Promoter sending that entrant commercial electronic messages (such as email) in relation to this Competition and other marketing campaigns. By entering the Competition and not signing up to the Expedia.com.au newsletter, each entrant consents to the Promoter sending that entrant commercial electronic messages (such as email) in relation to this Competition only. If an entrant wishes to stop receiving these messages, the entrant may use the “Unsubscribe” function at the bottom of such emails.
  39. All entries become the property of the Promoter. As a condition of entering this Promotion, each entrant licences the Promoter to use his/her entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry submitted contains a composition of the entrant. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth). The prize winner(s) agree to participate and co-operate as required in all editorial activities relating to the Promotion, including but not limited to being photographed and/or quoted. The winner(s) grant the Promoter a perpetual and non-exclusive licence to use their names and photos in all media worldwide and the winner will not be entitled to any fee for such use.
  40. The Promoter collects personal information about you in order to to enable you to participate in this Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. If the information requested is not provided, the entrant may not participate in the Promotion.
